CONSIGNMENT AGREEMENT

4. I (artist) reserve the copyright and all reproduction rights to these works. The gallery will not permit any of the art-works to be copied, photographed or reproduced without my written permission. All approved reproductions will carry my copyright notice: © 1999 MD (artist) (typical). The gallery will print on each bill of sale: "The right to copy, photograph or reproduce the artwork(s) identified here is reserved by the Artist, artist."

5. Upon sale of the work(s), the retail price less the gallery commission will be remitted to artist within thirty (30) days after the sale. The title to these works remains with me until the works are sold and I am paid in full, at which time the title passes directly to the purchaser.

6. You will assume full responsibility for any consigned work lost, stolen or damaged while in your possession. Consigned works may not be removed from your premises for purposes of rental, installment sales or on approval with a potential purchaser without my permission. I may withdraw my works on thirty (30) days written notice, You may return to me any of the consigned works on thirty (30) days written notice.

7. The consigned works will be held in trust for my benefit and will not be subject to claim by a creditor of the gallery. This agreement will terminate automatically upon my death, or if the gallery becomes bankrupt or insolvent. Either party may terminate this agreement by giving sixty (60) days notice in writing to the other party. Upon termination, all of my consigned artworks will be returned to me within thirty (30) days at your expense and all accounts settled.

8. Shipping of the consigned works to the gallery will be the responsibility of the artist. If the artwork does not sell during the time of this contract, the gallery is responsible for the retun shipping of the artwork to the artist. Any damage or loss is the responsibility of the gallery.

9. In any proceeding to enforce any part of this contract, the aggrieved party shall be entitled to reasonable attorney's fees in addition to any available remedy.
